About these terms
These terms are between your office and Storypie LLC, doing business as Lobbypie, a company based in Ohio, United States, at 3535 Rolling Hills Drive, Pepper Pike, OH 44124. In these terms, "we", "us" and "Lobbypie" mean Storypie LLC, and "you" means the office that orders.
By ordering, paying or using an office page, you agree to these terms, our privacy notice, our kids’ privacy notice and our voice and photo policy. The person who orders confirms that they are an adult with authority to agree for the office.
If we sign a separate written agreement with your office, such as for a group, a hospital or a franchise, that agreement adds to these terms, and where the two differ, the written agreement wins.
What Lobbypie is
Lobbypie is an office page for kids and adults. Visitors open it from a QR sign, an office link or a website button. They tap a team member, choose Kids or Adults in a dialog, then pick a question to read or listen to. The page never asks for an age and saves no child profile.
Every voice on an office page is made with AI: a designed voice is made from a written description, and a person’s own voice is made from their recordings, only with their permission.
Recordings may open and close with a short tune and may carry quiet background music, as your office chooses. A recording can also play the reader’s greeting, a short hello with the name visitors see and their role, or in words your office writes with that person’s permission, which your office turns on or off for each person; then it reads the question aloud, the answer and "Thanks for listening."
On Plus, an answer can also play as a short animated video, created with AI from its approved words and recording, with the reader’s avatar and voice. Each video plays only after your office approves it.
The content is for educational purposes only and is not medical advice. It does not diagnose a condition or give personal medical, dental, dosing or aftercare instructions. The office remains the place to ask about individual care.
Ordering
Ordering needs no password. You choose a plan, tell us about your place and pay by card on our payment provider’s secure page. After you pay, you set up your page in your Lobbypie account: your team, their photos, each person’s permission link, your questions and answers, drafted from your website if you share it, and your languages.
Each pictured person gives their own consent, and we make your page with your portraits, voices, greetings and answers. Before you turn it on, your office reads, listens to and approves every answer and greeting on it in your page’s own language, as set out under Content and page controls.
On Plus, we also make a short video of each answer. Each video plays only after your office approves it, as set out under Content and page controls.
Starter covers one location. Plus covers every location of your office at the Plus price, each with its own page, sign and QR code. You list your locations in your setup after you pay.
On Starter, you can switch to Plus in your setup to cover more locations. On Plus, new staff permission covers every location of your office, so until we start making your pages you can add or remove a location in your setup without asking anyone again. After that, or once someone on your team has given their permission under our earlier wording, which names its locations, a new location is added through Talk to us.
Paying
When you order, you choose to pay month to month or a year at a time, and you pay by card, at checkout on our payment provider’s secure page. Month to month, you pay the setup fee and your first month, and your subscription then charges the monthly fee each month on the same day, in advance, until you cancel.
Options beyond your plan, such as more staff members, answers or languages, or a Custom voice for a staff member on Starter, each have a one-time fee, charged when you add them, and a monthly fee, charged with your subscription. Plus includes a Custom voice for each staff member, at no extra charge.
A year at a time, you pay 12 months of the monthly fee up front, for the full year, with no setup fee or any other one-time fee, and your subscription renews each year on the same day, in advance, until you cancel. What you choose beyond your plan when you order is paid for the whole year in that same payment. Anything you add during the year is charged for the months left in that year, with no one-time fee, and then renews with the year.
If you pay month to month, you can switch to paying a year at a time on the plan page of your Lobbypie account. Before you confirm, we show what the switch costs, and when you confirm, it is charged at once to the payment method on file: a year of your plan and of the options you pay for each month, at 12 months of their monthly fees, paid up front, plus tax, less a credit for the unused part of the month you have paid for. The year starts on the day of the switch and renews on that day each year until you cancel.
You can switch from Starter to Plus in your Lobbypie account. Before you confirm, we show what the switch costs, and when you confirm, it is charged at once to the payment method on file. Options you already have carry over, those Plus includes stop being charged, and the unused part of what you have paid for is credited toward the switch. Nothing is refunded: a credit larger than what the switch costs is kept for your next bills.
If you pay month to month and stay month to month on Plus, you pay the one-time fees Plus would have for your page, less every one-time fee you have already paid for it, or nothing if that is as much or more, and the Plus price for the rest of your month, less a credit for the unused part of your month. Then you pay the Plus price each month.
If you pay month to month, you can instead start a Plus year from the day of the switch, paid up front for the full year with no setup fee or any other one-time fee, less a credit for the unused part of your month. Your renewal day becomes the day of the switch.
If you pay a year at a time, the switch starts a new Plus year from that day, paid up front for the full year with no setup fee or any other one-time fee, less a credit for the unused part of the year you paid for, options included. Your renewal day becomes the day of the switch.
Prices are on our pricing page. The prices shown when you order are the prices you pay, and your order keeps a copy of them. Prices do not include any sales tax that applies.
We take no card details on this site and never see your card number. Each later month, or year, is charged to the same card. Offices we invoice instead, such as offices outside the United States, get each invoice by email, due within 14 days.
If a monthly or yearly payment fails, our payment provider tries the card again and we email you reminders. If a payment is still unpaid 30 days after it was due, we pause your page, and it comes back on as soon as the payment is made.
How long it runs, and cancelling
Your service runs from the day you pay for your order, month to month or a year at a time as you chose, and renews each month or each year until you cancel or we end it under these terms.
You can cancel at any time from the billing page of your Lobbypie account, or by telling us through Talk to us from the email address on your order. Cancellation takes effect at the end of the month, or the year, you have paid for. Your page stays live until then, unless you turn it off yourself.
If you pay a year at a time, cancelling stops the next yearly renewal, and the months left in the year you paid for are not refunded.
We can end the service with 30 days notice by email. If we end it without cause, that is, for a reason other than a breach of these terms or an unpaid fee, we refund the unused part of the month, or of the year, you have paid for.
When the service ends, we take your page down and delete your team’s portraits, voices and recordings as our voice and photo policy sets out. Please take down any printed sign that shows a person who has come off your page.
Refunds
- What you pay once at order, the setup and every option you chose with it, pays for making your portraits, voices, content and signs. It is not refundable, with two exceptions. When we cannot deliver your office’s page at all, for example for a kind of place we cannot serve, we refund everything you paid once at order, in full. When we cannot make a Custom voice you paid for because of where your office is, we refund it, as the next line says.
- A Custom voice, your answers in a staff member’s own voice, is included with Plus for each staff member, at no extra charge, and is paid for each staff member on Starter, as set out under Paying. We do not make it where your office or any of its locations is in Illinois or Texas: then we refund each Custom voice you paid for.
- Monthly fees are not refundable, except for the unused part of a paid month when we end the service without cause.
- A year paid up front is not refundable, except when we cannot deliver your office’s page at all, when we refund it in full, or when we end the service without cause, when we refund the unused part of the year.
- Cancelling stops the next charge. It does not refund the month, or the year, you have already paid for.
Price changes
We can change our prices. A change to what your office pays takes effect no sooner than 30 days after we email the contact on your order. If you do not agree, cancel before the change takes effect, and the old price applies until then.
Your team’s consent
- Each person pictured gives their own consent, through their own private link. You share the link with them, or have us email it to them. You cannot give consent for anyone.
- Each person’s yes is a blanket permission for the content you approve. Within the limits their own permission names (your office’s pages, its audiences and its locations), it covers their name, role, avatar and likeness, the voice that reads for them, and the audio, video and text you approve for your page, now and later. You approve content only within those limits. New staff permission covers adults and kids, whichever you choose now or later, at every location of your office, today’s and any you add later. A permission given under our earlier wording keeps the audiences and locations it lists.
- Each person chooses how they appear, on their own link: their own photo shown as it is (cropped to a square around their face), a custom avatar drawn from their photo with AI, or an avatar from our collection. Under that person’s own permission we may show the look they chose, with their name and role and the voice that reads for them, on your page, its signs and its videos.
- You may change your page between adults, kids, or both at any time. New staff permission explicitly covers both audiences and future audience changes. An earlier narrower permission stays within its original limits until that person personally signs an audience addition on their private link. Changing the page setting does not extend anyone’s permission, approve content, or increase your paid answer allowance.
- When you have us email someone their link, you give us only an email address that belongs to that person and that you may use to reach them for work.
- You will not pressure anyone to say yes, and you will not treat anyone differently for saying no.
- Everyone pictured must be an adult who works with your office.
- You will only send headshots you have the right to use, showing only that person. This includes the photos of your team on your own website, which a person may choose to show as they are.
- When someone pictured takes their permission back on their own link, we take them off your page right away, and you cannot switch them back on: only they can give it again. When someone stops working with your office, or tells you rather than us that they take it back, you will switch them off or remove them from your Lobbypie account as soon as that happens. If you cannot, take the page offline and contact us immediately.
- You can switch each person off your page and back on from your Lobbypie account. Switching on someone who has not given their permission asks them for it on their private link, and they stay off until they say yes.
- We keep a permanent record of every yes, no and take-back, and of what your account does about a person’s permission, such as sending their link or taking them off your page, for 7 years. Nobody, including us and you, can change or delete it before then.
- When someone comes off your page, you will take down or replace any printed sign that shows them.
Content and page controls
Lobbypie provides general educational information only. It is not medical or other professional advice, diagnosis, treatment, clinical decision support or an emergency service. We do not provide clinical review or verify that content is appropriate for a particular patient. Ask a qualified health professional about personal care; in an emergency, contact local emergency services.
Content, translations, audio and videos may be created or checked with AI and can be inaccurate, incomplete, outdated or misleading. A familiar face or voice does not mean that person wrote or recorded the content, or provided clinical review of it. Our checks do not replace your office’s review.
Before opening your page or sharing any answer, your office must read, review and expressly approve every selected library answer, generated answer and custom question or answer, in your page’s own language and in every age range you intend to share, and listen to its audio. Our translations of what your office approves go up in your page’s other languages as set out below. Use qualified reviewers who understand the language and subject. Your office must check accuracy, suitability, pronunciation, professional standards and the needs of its intended visitors.
Your office is responsible for its selection, approval and use of content, the facts and instructions it supplies, the care and professional services it provides, and following the laws and professional duties that apply to it. When your office approves an answer or translation, it takes full responsibility for sharing every recording of its words with its visitors, including any error in a draft we prepared that its review did not catch. Do not rely on Lobbypie instead of professional judgment, or use it to delay or replace care.
Review and approve later additions and edits in your page’s own language before sharing them; our translations of them go up as set out below. Keep content current. If you find an error or content that is no longer appropriate, stop sharing it and tell us at once so it can be corrected; if it must not be heard meanwhile, turn your page off until it is. Approval of earlier words does not approve changed words.
Your office’s approval of an answer covers every recording of its words in that language: read by any person on your page, at every location of your order, and recorded or mixed again by us. Such a recording needs no new approval. A change to its words does, and so does a new recording of a question that your office asks us to make.
Translations: your office approves each answer and greeting in your page’s own language. Our translations of the words your office approved, and their recordings, go up in your page’s other languages once each passes our translation check, with no approval of their own. Where these terms speak of your office approving a translation, that is its approval of the words the translation was made from. A translation that does not pass our check stays off that language’s page. Your office can listen to each of its page’s languages, and can hide a language at any time from its Lobbypie account.
Each person’s greeting is reviewed, approved and shared like an answer, and what these terms say about your office’s review, approval and responsibility for answers applies to greetings too.
On Plus, each video of an answer waits for your office’s own approval before visitors can watch it: approving an answer does not approve its video. A video’s drawings and labels are created with AI and can contain errors, so watch each video in your Lobbypie account before you approve it. Your approval of a video covers it at every location of your order, and when we make it again from the same recording, words and drawings; a video whose recording, words or drawings change waits for your approval again. You can hide any video, or every video, at any time, and that answer then plays as audio. What these terms say about your office’s review, approval and responsibility for answers applies to videos too.
Once an answer has its audio, each edit your office approves to its words is a re-recording, and so is each question your office asks us to record again. Your order includes up to 5 re-recordings each calendar month on the Starter plan and 10 on the Plus plan, however many locations, languages and voices the answer plays in. A re-recording counts when your office approves it, and unused ones do not carry over. When they are used, a further edit or new recording waits until the next month. A new recording of a question replaces the one that plays only once your office approves it. Recordings we make again to correct our own error do not count.
You control whether your page is live. It may be opened only after your office completes the required review and approval. When it is off, its link shows your office’s name and a message to check back soon. Private previews keep their access protection.
How you may use it
- Use your Lobbypie page for kids and adults who visit your office.
- Share the office links and QR codes we provide, including links to specific answers and audience or language choices. You may include these public links in your own appointment messages. The same link serves every visitor.
- On your office’s own website, use only the website codes from our website page or your signs kit, exactly as we give them.
- Do not add tracking codes or patient details, alter website codes, or make links for individual patients.
- Show the office page only on your office’s own website. Your website’s own cookies, analytics and privacy notice are yours to look after.
- Do not copy, download, edit or post the portraits, voices, recordings or videos anywhere else.
- Do not add anything that asks a child for information.
- Keep your private order and office links to the people on your team who need them. Anyone who has a link can use it.
- Do not use Lobbypie to mislead, harass or harm anyone, or in a way that breaks a law that applies to you or to us.
- Do not try to get around how the service is protected, or use it for anything unlawful.
No patient information
Lobbypie is built to work without patient information, and we never ask for it. Do not send us names, health details or anything else about a specific patient in your order, your office answers or your messages. If it reaches us by mistake, we delete it.
Lobbypie receives no patient health information and is not your business associate under HIPAA. We do not sign business associate agreements, so nothing in these terms is one.
Lobbypie does not send messages to your patients. If you tell families about your office page in reminder texts or emails, you send them from your own systems, and you do not share patient contact details or appointment details with us.
Taking things down
You control whether your whole page is live. Turning it off prevents new content requests; it cannot erase media already loaded on a visitor’s device.
A person who takes their permission back on their own link comes off your page right away, with no step from you. Your office must still switch off or remove a person as soon as their employment or other work with the office ends, or as soon as they tell you they take it back. Do not wait for us to process a request. If you cannot, take the whole page offline and contact us immediately. Removal stops new access through the page; media already loaded on a visitor’s device cannot be recalled.
Each person keeps the independent right to withdraw consent through their own link or by contacting us. Your office cannot delay or override that choice, and cannot switch that person back on. Our withdrawal processing and storage deletion follow the voice and photo policy; removing someone from a live page does not mean every stored record is deleted immediately.
We may pause your page if we need to protect someone’s rights, or if these terms are not being followed. We will tell you why. We may also pause it if a payment is more than 30 days overdue, after emailing you a reminder, and turn it back on when it is paid.
When your office stops using Lobbypie, we take your page down and delete your team’s portraits, voices and recordings, as our voice and photo policy sets out.
Names, faces and voices
Each person’s name, face and voice belong to them. The portraits, voices, recordings and videos we make are for your office’s Lobbypie office page only, including where it is shown on your office’s own website. Portraits also go on the printed signs we make for your office. All of them are used only for as long as the people in them keep their permission. Your office answers stay your own words.
Software, libraries and your answers
Lobbypie, its software, its design, the base libraries and their answers, the designed voices, the music, the drawings and animation in our videos and the sign designs belong to us or to those who license them to us. For as long as your office uses Lobbypie and follows these terms, you may use them on your office page, on your own website through our website codes, and on the signs we make for you. That is the only license you get. You may not copy the answers, voices, videos or designs for use anywhere else, sell them, or use them to build a competing service.
Your office answers are your words and stay yours. You give us permission to show them on your page, to read them in the voices on your page, to make videos of them on Plus, and to translate them into the languages you ordered, for as long as your office uses Lobbypie.
If you give us your office website, you let us read its public pages and draft your questions and answers from them. Those drafts are yours to check, change and approve, like any answer.
When you approve your answers, you also let us write general versions of your office’s questions and answers, with your office’s name, people, places, prices, hours, insurance and own policies taken out, check them, and offer them to other offices as drafts those offices review and approve. The common answers we write for a kind of place are ours, and we may offer them to any office of that kind.
If you send us feedback or suggestions, we may use them without owing you anything.
What we promise, and what we do not
We promise to run your page with reasonable care and skill, to honor every person’s permission, and to handle information as our notices say. We make every attempt to check the accuracy of the content we prepare, but those checks are not clinical review and are not a promise that any content is correct: your office must read and approve every question and answer in its page’s own language, including those from our library, and each person’s greeting, and is solely responsible for all content on its page.
Apart from those promises and obligations the law does not let us exclude, we provide Lobbypie as it is. We do not promise that it will be free of errors, always available, accurate for clinical use or suitable for any individual, or that it will bring your office any particular result. Your office’s responsibilities for reviewing and approving content are set out under Content and page controls.
To the extent the law allows, we make no other promises, whether written, spoken or implied.
Limits of responsibility
Your office’s review and approval decides what its visitors hear and see. To the fullest extent permitted by applicable law, we are not liable to your office for any loss that arises from a version your office approved, including an error in a draft we prepared that its review did not catch.
To the fullest extent permitted by applicable law, if something goes wrong and it is our fault, the most we owe your office for all claims together is the amount your office paid us in the 12 months before the claim arose. To that same extent, we are not responsible for lost profits, lost patients, lost data or other indirect losses, even if we were told they might happen.
These limits and every other exclusion or allocation of responsibility in these terms do not exclude or limit obligations, rights, remedies or liability that applicable law does not allow us to exclude or limit, including harm we cause on purpose. They do not excuse our own fraud, willful misconduct or gross negligence. Where the law limits how far a term can go, it applies only as far as the law allows.
Claims from others
To the fullest extent permitted by applicable law, your office agrees to indemnify and hold harmless Storypie LLC and its personnel from third-party claims, damages, liabilities and reasonable legal costs to the extent arising from your office’s breach of its review, approval, removal, consent or other obligations under these terms; its selection, approval or use of answers, translations or audio; its own questions and answers; the photos or names it supplies; any link it changes or makes for an individual patient; or its care, professional services or unlawful conduct.
This obligation covers a claim about a version your office approved, even where the claim says that we prepared that version inaccurately or negligently. It does not cover the portion of a claim caused by our fraud, willful misconduct or gross negligence; by our serving a version your office had not approved, or a person after your office removed them from its Lobbypie account; or by any other breach of these terms by us, apart from an error in a version your office approved. It also does not cover any liability that applicable law does not permit us to transfer, and it does not waive any person’s nonwaivable rights or relieve us of our own nonwaivable obligations.
We will notify you promptly of a claim, reasonably cooperate and let you participate in its defense. You may not agree to a settlement that admits fault by us, imposes nonmonetary duties on us or fails to release us from the covered claim without our written consent, which we will not unreasonably withhold.
The law that applies, and disagreements
These terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules.
If there is a disagreement, tell us first, by email to hello@lobbypie.com or through Talk to us, and we will tell you if we have one with you. Both sides then have 30 days to work it out together in good faith before either goes to court.
A claim that is not resolved that way goes to the state or federal courts in Cuyahoga County, Ohio, and both sides agree to those courts. There is no arbitration, and neither side gives up its right to a jury. Either side can still ask a court to stop a misuse of faces, voices or content while a disagreement is going on.
Notices
We send notices to the email address on your order or account. Keep it current, and tell us if it changes.
You send notices to us by email to hello@lobbypie.com, where we reply within one business day, or by post to Storypie LLC, 3535 Rolling Hills Drive, Pepper Pike, OH 44124. We confirm by email that we received them.
The rest
- These terms, our notices and our voice and photo policy are the whole agreement between your office and us about Lobbypie, unless we sign a separate written agreement with you.
- If a court finds part of these terms cannot be enforced, the rest still applies.
- You may not pass these terms or your page to another business without our written agreement. We may pass them to a company that takes over Lobbypie, such as a separate company we set up to run it, and we tell you by email at least 30 days before that happens.
- Neither side is responsible for a delay caused by something outside its reasonable control, such as a natural disaster or a failure of the internet, but you still pay for the service you receive.
- If either side lets a breach go once, it can still act on a later one.
- The parts about names, faces and voices, limits of responsibility, claims from others and the law that applies continue after the service ends.
Privacy
Our privacy notice, kids’ privacy notice and voice and photo policy explain how we handle information.
Changes and questions
We can change these terms. When we do, we update the date at the top, and we email the contact on your order at least 30 days before a change that affects your office takes effect. If you do not agree with a change, cancel before it takes effect. Using Lobbypie after that date means you accept the new terms.
